On 23 June 2023, the Australian Government announced the new Australian visa charge. The new visa fee Australia will commence in July 2023.

Generally speaking, the process of Work Permit of Australia itself is very complex, and there is an age limitation for the Working Visa with PR pathway of 45 years old. This has been a hurdle for most candidates who are above 40 years of age.

Even though it is considered an obstacle, there are opportunities for you to get a working visa even though you are over 40 years old, adjusting to the work permit of Australia.

Visa Options for Temporary Working Visa in Australia with No Age Limitations

So, here ONE derland Consulting has listed some working permit of Australia that you may consider. Please be noted that the below listed visas are temporary.

1. Visa 400 (Temporary Work – Short Stay Specialist Visa)

This visa is for skilled employees highly specialized in certain occupations. Being highly specialized, means that your skill can help Australian businesses and it cannot be found in the Australian labor market.

You may consider this visa option if you meet the basic criteria

2. Visa 408 (Temporary Activity Visa)

This visa allows you to come to Australia on a short-term, temporary basis to conduct particular types of work. This visa has several streams which are specified for certain types of work.

3. Visa 403 (Temporary Work – International Relations)

This is a temporary visa that allows you to work in specified situations that benefit Australia’s international ties.

The specific thing that is done is usually in the form of temporary work related to the government in Australia.

4. Visa 482 (Temporary Skill Shortage)

2. Partner Visa Australia. If you are in a relationship (married or de facto) with an Australian citizen or an eligible New Zealand citizen, you may consider this option. The good thing is that the Partner Visa does not only offer you a work permit, but also a pathway to Permanent Residency.
3. Parent Visa Australia. If you have a child residing in Australia as a citizen or permanent resident, they may sponsor you for a Parent Visa Australia. This type of visa also offers you a pathway to Permanent Residency.
4. Global Talent Visa. This visa program is designed for highly qualified and professional employees from all over the world who wish to work and reside in Australia indefinitely.

Opportunities for Permanent Resident in Australia

Generally speaking, the opportunities to get Australian permanent residency through a working visa while being over 40 years old, is very limited. As seen above, the working visa options are mostly temporary visa based.

On 23 November 2023, the Australian Government announced ending the Covid-19 visa concession period for all affected visas. The cessation will take place on 25 November 2023. Some visa concessions will remain for certain visa applications lodged on specific dates.

See below how the changes affect each Australian visa.

Employer-Sponsored Visas

The following Covid-19 concession will be phased out:

• Periods of reduced work due to Covid-19 will not count towards meeting the work experience requirements for new ENZ/RMS TRT stream nomination applications.
• Covid-19 concession to the age exemption for applicants with high income will not apply to new ENS/RMS visa applications.

The age exemption for legacy 257 workers in Australia for a period of 12 months during the pandemic, from 1 February 2020 to 14 December 2021, will apply to ENS visa applications submitted before 1 July 2024.

Hence, from 25 November 2023, new nominations for the 186 Visa, 494 Visa and all temporary residence transition streams under employer-sponsored visas will require the 482 visa holders to have worked in a position with their sponsoring employer. Otherwise, have worked in the occupation for medical practitioners and certain executives, for 2 out of the previous 3 years.

Skilled Regional Visa

The concession previously applied to subclass 887, and the following will apply since 25 November 2023:

• All eligible subclass 887 visa applicants must be in Australia but not in immigration clearance when applying
• Access to shorter periods of employment and regional residence requirements will be dismissed

The applicants can only access the employment requirement concession under the following:

• Held an eligible skilled provisional visa during the concession period; and
• Make a valid application within 3 months of Monday, 26 February 2024

Family visas

Covid-19 concession will no longer apply to certain Partner and Child visa applicants who were not in Australia during the Covid-19 concession period. Note that the Covid-19 concession period starts from 1 February 2020 to 25 November 2023.

However, all Partner and Child visa applicants who applied before 26 November 2023, and were in Australia at any time during the concession period, will continue to be eligible for the Covid-19 concession.

Business Innovation and Investment Program Visas

Covid-19 concessions will remain applicable to 188 Visa â€“ Business Innovation Extension stream and 888 visa under all streams, which are lodged before the end of Monday, 26 February 2024.

Safe Haven Enterprise Visa

There is minimal impact on the Safe Haven Enterprise visa program. The Australian Government has provided Safe Haven Enterprise visa holders a permanent residency pathway through the Resolution of Status (subclass 851) visa.

Temporary Graduate Visa

The closure of the Covid-19 concession requires all applications for any stream of the Temporary Graduate visa to be lodged onshore from 25 November 2023. Meanwhile, subsequent entrant applications can be made in or outside Australia.

Granting the applications to applicants in or outside Australia will continue.

Federated States of Micronesia, Fiji, Kiribati, Nauru, Palau, Papua New Guinea, Republic of the Marshall Islands, Samoa, Solomon Islands, Timor-Leste, Tonga, Tuvalu, and Vanuatu may be eligible.

Visa allocations in Australia will be based on population size, migration opportunities, and participant perspectives, with consultation with Pacific partners to ensure shared needs and objectives.

Eligibility Criteria for Pacific Engagement Visa Program

Primary applicants must meet the following requirements to be eligible for the Pacific Engagement Visa:

• To enter the ballot, you must be between the ages of 18 and 45,
• have a formal ongoing job offer in Australia (or your partner/spouse must have a job offer).
• fulfil English language, character, and health requirements
• hold a passport for a participating country or have been born in or have a parent who was born in an eligible country.

What is the Ballot Process and How Much Does It Cost?

The ballot is an electronic random selection process, and those who are drawn from it can apply for a Pacific Engagement Visa. Before being granted a visa, applicants must demonstrate that they meet all relevant criteria.

Third Step of Australia PR pathways for Students: Get Your Australian Work Visa Application Ready

Now you have obtained the required work experience, fulfill the residency requirements and get the best score for your English language test. It is time to get your Australian PR application ready. The most common way is by applying for an Australian work visa.

Your Australian work visa application must be ready before your Temporary Graduate Visa (subclass 485) expires. Two of the following work visa programs can be your option:

General Skilled Migration Program

The General Skilled Migration Program offers three different visa subclasses, including 190 visa, 189 visa and 491 visa.

These visa subclasses work with a point-test scheme, in which you must obtain at least 65 points on your Expression of Interest application. These points are derived from several aspects, such as age, work experience, qualifications, English language proficiency, etc.

This program can be your way to get Australian PR, as long as you can obtain the point.

The plus point from these visa subclasses is that Visa 189 and Visa 190 offers you a direct permanent residency, meaning that you don’t need to apply for another temporary work visa.

Employer Sponsored Visa

The Employer Sponsored Visa offers some different visa subclasses with different streams, such as 482 visa, 186 visa, and 494 visa.

These visa subclasses work with sponsorship schemes. So, you must receive a sponsorship offer from the Australian company, either in a non-regional or regional area, to work for the company in order to obtain the Australian PR.

Other important information: Covid-19 Visa Concession is Over

You might have heard about this and it surely affects your migration plan. While previously the concession in meeting the work experience and age criteria were still in place, now you have to consider everything carefully and use your time in Australia wisely.

These recent changes require a more careful approach in the migration plan. The new criteria especially for work experience and age are affecting international students looking for work visas.

For example, subclass 408 visa used to be another option for people who couldn’t apply for a subclass 485 visa or needed more time on it to get work experience. The following English proficiency requirements will apply in early 2024:

• IELTS 5.0 or equivalent for ELICOS student visa applicants
• IELTS 5.5 or equivalent for student visa applicants undertaking foundation or pathway programs with reputable English language training
• IELTS 6.0 or equivalent for other student visa applicants
• IELTS 6.5 or equivalent for Temporary Graduate visa applicants

Due to the lack of opportunities for permanent residency, there is an increasing number of “permanently temporary” former international students residing in Australia.   • Quick processing: the government has promised a median visa processing time of seven days.

• Core Skills Pathway
  • Income must be at least TSMIT, which is currently $70,000, but it must be adjusted yearly.
  • A more straightforward and frequently updated Core Skills Occupation List for jobs that Jobs and Skills Australia has determined are in short supply or for jobs that are specified in international trade agreements.
  • It is most likely that most skilled workers will come through this pathway with likely similar process as the current visa program

• Essential Skills Pathway

The government is currently assessing further ways to improve this TSMIT pathway for lower-paid workers who possess necessary skills and are sponsored by labour agreements. Many of these workers currently receive sponsorship.

These new arrangements would be subject to additional advice from Jobs and Skills Australia and its tripartite mechanisms. They would also be sector-specific, capped, embedded with stronger regulation and minimum standards.

The situation will be more complex if you’ve overstayed your visa for more than 28 days. You are still required to report to the Department before leaving the country. If you attempt to leave the country without reporting, then you may be detained at the airport.

If you need more time to arrange your departure, the Status Resolution Centre will guide you to apply for a Bridging Visa E, but you must ensure that you will leave Australia before your Bridging Visa E expires.

And this is where the situation is getting worse. Once you leave the country, you will be banned from obtaining a visa or entering Australia for minimum 3 years, even though you show valid reasons for overstaying your visa.
